Out of court first.
In court if necessary.

1. Formal demand

A burofax with acknowledgement of receipt that puts the claim on record and stops the limitation period.

2. Order-for-payment proceedings

A fast judicial route for documented debts ("monitorio"). The debtor has 20 days to pay or contest the claim.

3. Declaratory trial

If the claim is contested, we continue with oral or ordinary proceedings until we obtain a judgment and seize assets.

Common questions
about debt recovery

How can I claim an unpaid debt?
Through a prior formal demand with proof of delivery (burofax) and, if payment is not made, by starting order-for-payment ("monitorio") or declaratory proceedings before the court.
What are order-for-payment proceedings?
They are a fast judicial route to claim monetary debts of any amount that are documented through invoices, delivery notes or contracts.
Can I claim without going to trial?
Yes, out-of-court negotiation is the first step and makes it possible to reach payment agreements or partial write-offs that save time and litigation costs.
Which documents prove the debt?
Signed invoices, delivery notes, service contracts, emails acknowledging the debt or any document that proves the commercial relationship.
How long do I have before the debt becomes time-barred?
The general limitation period for commercial and contractual debts is 5 years from the moment payment could be demanded.
