Part-timers without records get expensive

Without daily records and the monthly summary (art. 12.4.c), in court a part-time contract is presumed full-time. And extra hours without a written agreement should never have existed.

Staff transfers cut both ways

Taking over a contract means taking on its staff with seniority and conditions; losing one means handing over the file on time. Getting it wrong ends in claims from both sides.

Are working-time records mandatory for my part-time staff too?
Especially for them. Daily records have been mandatory for all staff in Spain since 2019 (art. 34.9 of the Workers' Statute), and for part-time contracts the requirement is stricter: day-by-day records plus a monthly summary delivered with the payslip (art. 12.4.c). Without that record, in court the contract is presumed full-time. We set up a system that survives an inspection.
Can I ask my team to clock in with geolocation?
Yes, within limits: location must be proportional (only at the moment of clocking in), informed (staff know what is collected and who sees it) and never continuous tracking. Workers' representatives must also be informed. We prepare the information clause and the system so the clock-in is valid and defensible.
We're taking over a contract another company used to run. What happens to their staff?
The cleaning sector's collective agreement requires taking on the staff assigned to the site when the contract changes hands: you take those people with their seniority, hours and conditions, and the outgoing company must hand you the complete file within the deadline. The same applies when you lose a contract. We handle the whole transfer, with the file and the agreement's deadlines.
A worker on a 20-hour contract works extra hours. How are they paid?
As top-up ('complementary') hours, never overtime: on a part-time contract overtime doesn't exist (except force majeure). They're paid as ordinary hours and require a written agreement with a limit. With no agreement, that excess should not have happened, and in a dispute it works against you. We draft the agreements and monitor the limits so part-time hours are properly paid and documented.
What can happen in an inspection if my staff sign on paper?
The signature sheet in the lobby rarely holds up: it gets signed in bulk, gets lost and doesn't prove the real start and end of the working day. A serious infringement of working-time record rules carries fines of €751 to €7,500 per work centre (LISOS, art. 7.5) — and with dozens of buildings that multiplies. Can my cleaners be self-employed?
Generally, no: if they clean your sites with your organisation, your schedules and your clients, they are employees, and keeping them as self-employed is a false self-employment arrangement, with penalties and back contributions. We review your structure and set up the correct contracts under the sector's collective agreement.
