Do you work remotely

The Spanish Startups Act 2023 created two distinct pathways. Each has its own requirements and process. We help you work out which one fits your situation.

Digital nomad visa

For people who work remotely for a foreign company or provide services to international clients from Spain.

  • Contract or employment relationship with a foreign company
  • Or freelance activity with clients outside Spain
  • Minimum income equal to 200% of the Spanish minimum wage (SMI)
  • Private health insurance or equivalent public coverage
  • Clean criminal record
  • Initial duration: 1 year, renewable

Startup Visa / Entrepreneurs

For founders of innovative business projects with activity or planned expansion in Spain.

  • Innovative, scalable business project
  • Can be applied for from the consulate or within Spain
  • Includes authorisation for spouse and children
  • Access to the special tax regime (Beckham Law)
  • No minimum residence requirement in Spain
  • Renewable for as long as the project continues

to decision

Assessment

about the Startup Visa and digital nomads

What is the Startup Visa and who can apply for it?
It is a fast-track residence authorisation under Law 14/2013, aimed at non-EU entrepreneurs who want to develop an innovative business activity of particular economic interest for Spain.
What requirements must the entrepreneurial project meet?
The business plan must demonstrate a strong technological component, potential for local job creation, a scalable model, and obtain a favourable viability report issued by ENISA.
What is the digital nomad visa?
It is a residence permit under Law 14/2013 for non-EU citizens who wish to live in Spain while working remotely for companies located outside Spain.
Can I bring my family with the Startup Visa or the digital nomad visa?
Yes, the law allows simultaneous or subsequent residence permit applications for your spouse or unmarried partner, minor children and dependent ascendants, with full residence and work rights.
How long does approval take?
The Large Business Unit (UGE) has a maximum of 20 working days to decide. If no express decision is issued within that period, administrative silence operates in the applicant's favour.
