Everything you can
claim after an accident

The Spanish traffic accident compensation scale (Law 35/2015) sets specific compensation for each type of harm. Many victims receive less than they are entitled to simply because they do not know their rights.

  • Basic damages: temporary injuries during recovery
  • Specific personal harm: ICU admission, surgery, after-effects
  • Moral damages: your own suffering and your family's
  • Loss of earnings: income lost during sick leave and permanently
  • Vehicle damage and compensation for loss of use
  • Medical, rehabilitation and travel expenses
  • Home or vehicle adaptations for serious after-effects
  • Third-party care allowance in cases of permanent disability

How much are you owed?
The scale is set by law

Temporary injuries

Between 35 € and 92 € per day depending on whether you are hospitalised, incapacitated or in outpatient recovery. The number of days is certified by the doctor.

Permanent after-effects

A score from 1 to 100 based on the scale's medical tables. Each point is worth between 780 € and 3,450 € depending on age and the severity of the harm.

Wrongful death

The families of fatal victims are entitled to compensation for basic and specific personal harm, with set amounts for spouses, children, parents and siblings.

Loss of earnings

If your injury prevents you from working during recovery or permanently, you are entitled to compensation for lost income, calculated on your actual payslip.

Common questions
about traffic accidents

What can I claim after a traffic accident?
You can claim for physical injuries, permanent after-effects, days off work, damage to your vehicle and loss of earnings (income you were unable to earn).
How is the compensation calculated?
It is calculated by applying the official traffic accident compensation scale (Law 35/2015), which assigns a value to each point of after-effects and each day of recovery according to the victim's age and circumstances.
How long do I have to make a claim?
You have 1 year from the moment your injuries have stabilised (medical discharge) to start the civil claim.
What should I do right after the accident?
Fill in the accident report form or call the police, identify witnesses and go to A&E within 72 hours so your injuries are properly documented.
Can I claim if I was a pedestrian, cyclist or passenger?
Yes, in these cases you are almost always entitled to compensation, since you are not the driver responsible for the accident.
